Terms of Service

These terms are the agreement between you and NRGym, which operates GyMap, when you use the GyMap member app or web portal. Please read them, and in particular the health and fitness section. By creating an account or using GyMap, you accept these terms.

About these terms

GyMap is operated by NRGym (The Mill, Greengate Road, Keighley, BD25 1JH). These terms cover your use of GyMap as a member. Your gym may also have its own rules and membership agreement, and those are between you and your gym. Gyms that use GyMap do so under a separate agreement with us.

Who can use GyMap

To use GyMap you need to be a member of a gym that uses it, be old enough to enter into a contract (generally 18, or 16 and over with the involvement of your gym and a parent or guardian), and give accurate account details.

You are responsible for keeping your login secure and for activity that happens under your account. Tell us or your gym straight away if you think someone else has access to it.

Health and fitness: please read

GyMap provides fitness information and tools. It does not provide medical advice. Workout plans, exercises, tests and guidance in the app are general and may not be suitable for your individual circumstances.

Always speak to a qualified doctor before starting or changing an exercise programme, especially if you have an injury or health condition, are pregnant, or have any doubts about your fitness to train. You take part in exercise at your own risk. Warm up properly, use correct technique, and stop and seek help if you feel unwell, dizzy or in pain.

To the extent the law allows, NRGym is not responsible for any injury, illness or loss resulting from following a plan or using the app. The coaching, supervision and safety of any in-person training remain the responsibility of your gym and its staff.

The service

GyMap includes workout plans and tracking, progress and body metrics, fitness tests, class schedules and attendance, events, an in-app shop, notifications, and, where your gym offers it, a Premium subscription. We keep improving the platform and may add, change or remove features.

Payments for shop and events

Some products and events are paid. Payments are taken securely through our payment provider, Stripe. Prices are set by your gym and shown to you before you pay. When you buy an item or book a paid event, you enter into a contract for that purchase, and your card details go directly to Stripe rather than to GyMap.

Premium subscription

Where your gym offers Premium, it is a recurring subscription billed through your gyMap account on the web, using our payment provider Stripe, as shown at checkout. It renews automatically until you cancel. You can cancel at any time and keep access until the end of the period you have paid for, and you will not be charged again after that.

Refunds and cancellations

Refunds for shop orders and event bookings are handled by your gym, in line with your legal rights as a consumer. If your gym cancels a paid event, you will be refunded. For any question about a purchase, contact your gym. Nothing in these terms affects your statutory rights.

Your content and conduct

You keep ownership of the content you add, such as your workout logs and photos. You give us permission to store and process that content so we can provide the service to you.

You agree not to misuse GyMap. That means no unlawful use, no attempts to break or bypass its security, no accessing data that is not yours, and no uploading content that is harmful, offensive or infringes someone else's rights.

Third-party services

GyMap relies on trusted third parties, including Stripe for payments and Apple and Google for app distribution and notifications. Your use of those parts of the service is also subject to those providers' terms.

Availability

We work hard to keep GyMap available and reliable, but we provide it as is. We cannot guarantee that it will always be available, uninterrupted or free of errors, and we may carry out maintenance or change the service.

Our responsibility to you

Nothing in these terms limits any liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.

Subject to that, and to the extent the law allows, we are not liable for indirect or unforeseeable losses, for loss arising from decisions your gym makes, or for events outside our reasonable control. These terms do not affect your rights as a consumer.

Suspending or closing your account

You can stop using GyMap and ask to close your account at any time. We or your gym may suspend or remove your access if these terms are broken, or if your membership with the gym ends.

Changes to these terms

We may update these terms from time to time. If we make a material change we will let you know, and the date at the top shows when they were last updated. If you keep using GyMap after a change, you accept the updated terms.

Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK, you keep the benefit of any mandatory consumer protections that apply where you live.
